1. Parties
These terms apply to any construction work carried out by Humphries Construction ("we", "us"), an owner-managed business based at Station Cottage, Gayton Road, East Winch, Norfolk, for the customer ("you") named on the written quotation.
2. Quotations
All quotations are provided in writing, itemised line by line, and are valid for 30 days from the date of issue. A quote becomes a binding contract only once you have accepted it in writing (email is acceptable) and paid any deposit stated on the quote.
3. Site survey and access
We provide a free site survey within 7 days of your enquiry. You confirm that you are the property owner or have written authority from the owner to instruct works, and that safe access is available during agreed working hours.
4. Payments
Payment terms are set out on your written quotation and typically comprise a deposit on acceptance, stage payments against agreed milestones, and a final balance on practical completion. Invoices are due within 7 days unless stated otherwise. We accept BACS transfer; card and cash are available by arrangement.
5. Variations
Any change to the agreed scope of works, whether client-requested or arising from ground conditions discovered on site, will be raised in writing as a variation. Work on the variation only begins once you have signed it off, and the price and programme impact are agreed before the work is done. This is the only mechanism by which the fixed price changes.
6. Programme
Start and completion dates are given in good faith on the written quotation. We are not liable for delays caused by weather, statutory undertakers, materials supply, Building Control, planning authorities or your instructions. You will be notified of any delay the same day it becomes apparent.
7. Guarantees
We provide a 10-year structural warranty on extensions from the date of practical completion, and a 2-year workmanship guarantee on garage conversions. Both are on your written contract before start on site. Warranties do not cover misuse, third-party alteration, lack of reasonable maintenance, or fair wear and tear.
8. Insurance
We hold £1,000,000 public liability insurance. A certificate is available on request before start on site.
9. Materials and title
Materials remain our property until paid for in full. Once fixed to the property, they become part of the works and title passes on payment of the relevant invoice stage.
10. Liability
Our total liability for any claim arising out of the works is limited to the contract price. Nothing in these terms limits liability for death, personal injury caused by negligence, or any liability which cannot lawfully be excluded.
11. Cancellation
Consumers have the right to cancel a contract entered into off-premises within 14 days without giving reason, in line with the Consumer Contracts Regulations 2013. If you ask us to start work within the 14-day period, you may be liable for the value of works performed up to cancellation.
12. Governing law
These terms are governed by the law of England and Wales. Any dispute is subject to the exclusive jurisdiction of the English courts.
